Terms and Conditions

These Terms and Conditions (“Terms”) are entered into between:

The Traveling Mindset Group, LLC dba The Traveling Mindset (“Agency,” “we,” “us,” or “our”)
and
You (“you,” “your,” or “Traveler”)

(each a “Party” and collectively the “Parties”).

By accessing, booking, or using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms.

1. Effective Date & Acceptance

These Terms become effective upon the earlier of:

  • Your written, digital, or electronic acceptance; or
  • Your booking, payment toward, or use of any Travel Services

These Terms remain in effect until terminated by either Party in writing.

We reserve the right to update or modify these Terms at any time. Continued use of our services constitutes acceptance of any changes.

2. Definitions

  • Booking: A reservation made by Agency for Travel Services
  • Supplier: Third-party provider of Travel Services (e.g., airlines, hotels, tour operators)
  • Traveler: You and/or any individual included in your Booking
  • Travel Services: Travel-related products and services arranged through Suppliers
  • Trip: The complete set of Travel Services booked
  • Trip Documentation: All confirmations, itineraries, and pricing details provided

3. Traveler Obligations

You agree to:

  • Carefully review all Terms, Trip Documentation, and communications
  • Notify us within 24 hours of any errors
  • Provide accurate and complete booking information
  • Make all payments on time
  • Stay informed about travel advisories and requirements

You confirm that you are at least 18 years old and authorized to accept these Terms on behalf of all Travelers in your Booking.

4. Suppliers & Third-Party Services

We act solely as an intermediary between you and independent Suppliers.

  • Suppliers are not controlled by us and operate under their own terms
  • We are not responsible for service failures, delays, cancellations, or errors caused by Suppliers
  • Supplier terms apply to all bookings and must be reviewed carefully

Failure to comply with Supplier terms may result in:

  • Cancellation of services
  • Denied boarding or access
  • Loss of payments

5. Pricing & Payments

5.1 Pricing

  • Prices are based on the inclusions in your Trip Documentation
  • Prices may change until full payment is received
  • Additional fees (taxes, surcharges, upgrades, etc.) may apply

5.2 Payments

  • Deposits and full payments must be made according to agreed deadlines
  • Failure to pay may result in cancellation and forfeiture of funds
  • Payments are typically processed in U.S. dollars

5.3 Credit Card Authorization

By providing payment details, you authorize us to charge your card for agreed amounts.

6. Changes, Cancellations & Refunds

  • All cancellations and changes are subject to Supplier policies
  • Refunds are not guaranteed and depend on Supplier terms
  • Fees and penalties may apply
  • No-shows may result in loss of up to 100% of the booking value

We are not responsible for refunds beyond Supplier policies.

7. Travel Documents & Requirements

Travelers are responsible for:

  • Valid passports (typically 6 months beyond return date)
  • Visas and entry requirements
  • Health documentation and vaccinations

We are not liable for denied entry due to incorrect or missing documentation.

8. Travel Risks & Insurance

We strongly recommend purchasing travel insurance.

  • We are not an insurance provider
  • Insurance is offered through third parties
  • Coverage, exclusions, and claims are handled by insurers

If you decline insurance, you assume full financial risk, including cancellations, medical emergencies, and travel disruptions.

9. Liability & Limitation of Responsibility

We do not control Suppliers and are not liable for:

  • Delays, cancellations, or service failures
  • Injury, loss, damage, or death
  • Force majeure events (natural disasters, pandemics, etc.)

Our total liability, if any, is limited to the commissions received for your booking.

10. Force Majeure

We are not liable for failure or delays caused by events beyond our control, including:

  • Natural disasters
  • Pandemics or epidemics
  • Government actions
  • Wars or civil unrest

In such cases, itineraries may be modified or canceled without refund.

11. Traveler Conduct

Travelers are responsible for their behavior and any damages caused.

Suppliers or authorized parties may deny services or remove Travelers who:

  • Pose safety risks
  • Engage in disruptive or unlawful behavior

No refunds will be issued in such cases.

12. Personal Information & Privacy

By booking with us, you consent to the sharing of your personal data with Suppliers and third parties as necessary to complete your travel arrangements.

We are not responsible for third-party data handling practices.

13. SMS Communications

By opting into SMS, you agree to receive messages for:

  • Booking updates and reminders
  • Payment notifications
  • Travel-related communications

You may opt out at any time by replying “STOP.” Standard messaging rates may apply.

14. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Washington.

  • Disputes will first be addressed through informal resolution
  • If unresolved within 60 days, disputes will be handled in Washington courts
  • Class actions are not permitted

15. General Provisions

  • These Terms represent the entire agreement between the Parties
  • Any invalid provision will not affect the remainder
  • No partnership or agency relationship is created

16. State of Washington Compliance

The Traveling Mindset complies with the Washington State Sellers of Travel Act (RCW 19.138).

Seller of Travel Credentials

  • WA UBI #: 605-900-921
  • Registered with Washington State

If services are canceled:

  • Refunds will be issued within 14 days (if funds not sent to Supplier), or
  • Within 30 days after receiving funds back from Suppliers

17. Additional Registrations

The Traveling Mindset Group, LLC operates as:

  • An independent agency under Nexion Travel Group
  • California Registered Seller of Travel: CST 2071045-50

Registration does not imply state endorsement.
